World Pirate Tours Waiver, Risk Acknowledgement & Media Consent
By booking or taking part in a World Pirate Tours experience, you confirm that you have read, understood and agree to the following.
World Pirate Tours may include walking between venues, boarding and leaving boats, spending time near water, taking part in group games and activities, and visiting bars, boats and public spaces.
You understand that there are risks involved, including but not limited to uneven surfaces, steps, ramps, gangways, wet or slippery floors, cobbles, kerbs, changes in ground level, being next to water, boarding boats, busy public areas, weather conditions, and optional group games or sporting-style activities.
Some activities may include physical movement, balancing, pulling, throwing, dancing, sword fighting games, tug of war, walk the plank, beer pong, party games or other challenges. These activities may carry a risk of slips, trips, falls, collisions, strains, minor injuries or more serious injury.
All activities are optional. You should not take part in any activity if you feel uncomfortable, unwell, injured, heavily intoxicated, pregnant, have a medical condition, mobility issue or any other concern that may make participation unsafe.You agree to take responsibility for your own behaviour, decisions and safety during the tour. You agree to follow all reasonable instructions from World Pirate Tours staff, boat staff, venue staff, security staff and any other authorised personnel.
You are responsible for drinking responsibly and knowing your own limits. You may decline any drink or drinking-related activity. World Pirate Tours, boat operators, venues and security staff may refuse participation, service or entry if they believe you are too intoxicated, unsafe, abusive, disruptive or behaving inappropriately.
You agree not to climb on, lean over, jump from, sit on or misuse railings, barriers, boat edges, gangways, waterside structures, furniture or venue equipment. You must not enter the water under any circumstances unless instructed in an emergency by authorised personnel.
You are responsible for your own belongings, including phones, bags, fancy dress items, accessories, clothing and valuables.
You may be held responsible for any damage, loss, cleaning costs, injury or other costs caused by your own behaviour, negligence, intoxication, misconduct or failure to follow instructions.
World Pirate Tours does not exclude or restrict liability for death or personal injury caused by its negligence, fraud, fraudulent misrepresentation, or any other liability that cannot legally be excluded.
Subject to the above, you accept responsibility for injuries, losses, damages or incidents arising from your own actions, choices, intoxication, failure to follow instructions, participation in optional activities, or behaviour during the tour.
Media Consent
World Pirate Tours may take photos and videos during the tour for promotional, marketing and social media purposes.By taking part, you agree that World Pirate Tours may use photos, videos, audio, testimonials and other content featuring you on social media, the World Pirate Tours website, paid adverts, digital marketing, printed materials and other promotional channels.
Content may be edited, cropped, captioned, combined with music or used as part of promotional material. You will not receive payment or compensation for the use of this content.
If you do not want to appear in promotional content, please tell World Pirate Tours staff before the tour begins. We will make reasonable efforts not to use identifiable images or videos of you where you have opted out.
Participant Confirmation
By booking, signing, ticking the acceptance box, verbally agreeing on video, or taking part in the tour, you confirm that:
You have read and understood this waiver, risk acknowledgement and media consent.
You accept the normal risks involved in the tour.
You are responsible for your own behaviour and drinking responsibly.
You will follow staff instructions and venue rules.
You understand that activities are optional.
You are happy for World Pirate Tours to use photos and videos of you for marketing, unless you tell staff before the tour that you do not consent.
